Paramedic quits amid charges

These men were charged with civil rights intimidation on 7/10/11 James Smiley, 27, and Kyle Montgomery, 21, Colton Partin, 21.

A Hamilton County paramedic resigned Monday afternoon after being accused of throwing lit fireworks and shouting racial slurs at a public housing complex, authorities said.

James Smiley, 27, and two other men are accused of throwing the fireworks in the direction of the East Lake Courts public housing complex while shouting racial slurs at people sitting outside early Saturday morning.

Smiley, Colton Partin, 21, and Kyle Montgomery, 21, were arrested shortly after they drove away from the complex. Fireworks were still in their truck bed, and the three admitted to the harassment, according to a court affidavit.

All three are charged with civil rights intimidation.

Attempts to reach Smiley were unsuccessful Monday.

Smiley had been a paramedic with Hamilton County Emergency Services since September 2009, according to Mike Dunne, spokesman for Hamilton County mayor’s office.

Smiley submitted his resignation after an “interdepartmental hearing” during which he was questioned by his superiors. Dunne would not say whether Smiley was asked to submit his resignation.

On Saturday, the fireworks shattered a window in one of the units where children were sleeping, neighbors said at the time.

Angela Williams, who lives in the unit next to the one where the window was shattered, told the Chattanooga Times Free Press that she was on her front stoop with friends around 3:40 a.m. when the truck rattled by and she heard the shouts and the explosions.

“We froze; we thought it might be gunshots,” she said. “Then we all hustled inside. They drove by, threw out the packs of fireworks, then turned around and drove back down.”

The next court date for the three men is scheduled for Friday before Hamilton County General Sessions Court Judge Clarence Shattuck.

throwing fireworks while driving is idiodic, however we are only receiving information the media wants us to. as usual, trying to make this a white vs black issue without all the facts is the main problem with the majority of the so called "news". i hope the truth comes out, whatever it is, and the appropriate punishments are handed down.

openminded, you're doing exactly what you're accusing tfp of doing. Stating only part of the facts. Throwing fireworks was idiotic, and alone makes it appear a prank. But you left out the shouting of racial slurs on purpose, no doubt.

Why weren't they also charged with making terroristic threats? I think the arresting cops were trying to already give them an out from the start. I can come up with several charges they should be facing. Including vandalizing government property.

The 3 made this racial, white vs black, when they admittedly shouted racial slurs at the tenants. In fact, one lives not far from E. Lake Courts on 7TH Ave. Only about 3 streets over?

But like those loons who inspired the crazies like Jared Lee Loughner to act in the Arizona shooting massacre that killed 9 people, including a 9yr old child, the skillerns and thurmans inspire the local fruitybars with their ignorant racist rants, no doubt.

The actions of these 3 idiots, they are not juveniles going a a juvenile prank, could have resulted in the death of someone, some child. Firecrackers have been known to set off fires and burn down entire homes. In this dry weather, what they did could have turned deadly. There was an incident years ago where a firecracker was thrown through a bedroom window and landed in a crib where the infant received second and third degree burns. Just wait 'til the housing authority file their charges. Smiley should have his EMT license revoked.

Liber4F, have you been sleeping, r. vanWINKLE4? According to the police report, when police caught up to them, they admitted to everything. Even targeting African-Americans specifically. Now, with all that support you've given the local police even when they've been caught doing wrong, you're now saying Offcer Brian Angel is lying? Interesting how you suddenly switch when it's white guys in trouble. Or are they personal friends of yours?

They admitted to "harassment", haikook. The charge is "civil rights intimidation". Let's wait and see what the judge has to say at their trial. The accusers will be under oath and that might make a difference...or not.

As if people won't lie under oath. Are you kidding? HeLL! Even cops are known to regularly lie under oath with impunity. You must be out of your everlasting mind, row row! What are you smoking today?

Ummm! roly, you sure seem to know quite a bit about how the stuff is used. You're revealing too much about your lifestyle than you intended?

My side? Which side might that be? You're far too funny to be taken serious. LOL!
