Chancellor Frank Brown has dismissed a lawsuit filed against the Hamilton County Election Commission by Councilman Peter Murphy contesting District 9 election results.
Chris Clem, Hamilton County Election attorney, said this morning he received a personal fax from Brown stating the case would be dismissed and he would write a more detailed order later today.
Clem said Brown cited the lawsuit exceeded the five-day statute of limitations required by state law for election issues. Brown noted in the fax that write-in votes should not be counted as votes, Clem said.
Murphy filed the lawsuit after losing the March 5 city election by six votes to Yusuf Hakeem.
