A bond today for a man charged in a Dec. 17 "road rage" homicide resulted in no change to his original $350,000 bond. His preliminary hearinghas been rescheduled for Jan. 28.

Richard Allen Manning, 62, was charged with criminal homicide and and aggravated assault in the shooting death of Norman Gallman, 39, at the intersection of Moore Road and North Terrace.

Lloyd Levitt, Manning's attorney, argued at today's bond hearing for his client, that Manning was too ill to remain in jail as he awaited the outcome of the charges.

Manning has had cancer, currently battles diabetes, cellulitis and congestive heart failure, Levitt said.

General Sessions Court Judge Christie Mahn Sell kept the bond at $350,000 and scheduled the preliminary hearing for Jan. 28 after Manning could not make it to court while being treated at Erlanger Hospital today.

He's been in the hospital since Friday. At his scheduled preliminary hearing the judge will weigh whether there is enough probable cause to send his case to the grand jury for a possible indictment.

Hamilton County Sheriff Jim Hammond confirmed that Manning was still in custody while being treated and there would be guards on him "around the clock."
