Smith: IMMIGRATION FACTS: It's all about following law

As I write this, the latest drama in Washington, D.C., is the attempt to deal with an estimated 11 million individuals who are in the country without following the process of legal immigration.

A U.S. Senate proposal, along with a few amendments, including one offered by Sen. Bob Corker, claims that border security will eventually be tighter after the process of "legalization" occurs.

The legislation would require a probationary status be awarded to those who become documented. This would permit residency, legal work and access to most taxpayer-funded benefits through states that allow welfare to those lawfully present in their boundaries.

But did you know that back in 1986, Ronald Reagan signed an immigration reform bill passed with bipartisan support in Congress? That "sweeping reform" included "legalization," a pathway to citizenship and border security measures, too.

Since Nov. 6, 1986, in the United States of America, the Immigration Reform and Control Act has been law.

See if any of these mandates from 27 years ago sound familiar:

• It was made illegal to knowingly hire or recruit undocumented immigrants.

• Employers were to attest to their employee's immigration status.

• All were to enroll in at least 40 hours of English instruction prior to receiving a green card.

• Those immigrants who entered the U.S. prior to Jan. 1, 1982, and resided here continuously were legalized with the penalty of a fine, paying back taxes and declaring an admission of guilt.

• Increased border patrol with enhanced inspection and enforcement mandates.

Three million individuals who deliberately side-stepped the legal process to come to America were given amnesty. And about those other provisions of the law? I think it's obvious that enforcement disappeared, along with our trust.

Then, there's the 2006 law signed by George W. Bush, the Secure Fence Act. This law mandated the Department of Homeland Security to add more than 700 miles of double-layered fence that included areas in Texas, Arizona and California, according to the Washington Post. Only 36 miles have been built according to the law's specifications.

The cynicism is explained.

Ironically, while America has struggled to deal with the hundreds crossing our southern border daily, Mexico announced in September 2010 that it would build its own border wall to separate Mexico and Guatemala.

Raul Diaz, of the "Mexican Superintendancy of Tax Administration" defended his nation's decision to limit criminal activity and admitted "it could also prevent the free passage of illegal immigrants."

You see, according to Mexico's National Commission on Human Rights, 500,000 people from Central America cross the nation's southern border "illegally every year."

America sends millions in financial aid annually to Mexico and has essentially stopped enforcing current immigration law under the Obama Administration. The government of Mexico remains a vocal opponent of any enforcement of immigration law and continues to hold open its hand for more financial support. Yet, this same government attempts to stem the tide of illegal immigrants from its Guatemalan neighbors under the reasoning of sovereignty and security.

Really?

Americans are proponents of legal immigration. Just as a citizen is required to produce identification and follow specific procedures to board an airplane or to enter most federal buildings, the average person simply desires to see current law enforced and the pathway to citizenship to be uniform and equally enforced.

The issue is being a nation of laws. If you think otherwise, just try running past the magnetometers at the airport with no identification while ignoring the orders of law enforcement.

Where has Robin been?

Obama has detained and returned record numbers of undocumented aliens during his first term. The net flow of "illegals" entering the US is now essentially ZERO.

Border security is not nearly so important as employment screening. [I live in Canada and I can tell you that if you aren't a citizen and don't have a Personal Residency Card (Green Card in US) or temporary work status logged into a government data base, you won't be working. Oh, you might pick up some casual labor dollars, but not a job. The same can be done in the US, only the will is lacking.]

Robin says that she just wants the laws enforced and apparently opposes the reform measures. Obama has put money and boots on the ground to enforce the laws and now wants to resolve the difficult problem of those who are already in the US. That seems like a reasonable approach. Robin needs to put down her Boo Horn and help get this bill passed. If this bill falls short of perfection, then we can talk about additional measures.

If anyone wants to understand why the American public has no trust with their elected officials, this is a prime example. The citizens who lawfully elected the Bob Corkers, the Lamar Alexanders, the Marco Rubios, etc. are the ones who are being ignored, who abide by our rules.

As for nanuck, there is monumental evidence that demonstrates the Obama administration has stopped enforcing the immigration laws and has even released illegal immigrants by the thousands. Stop attacking the messagers who have enough guts to tell the truth.

If true, suspending deportations may not be a bad thing, since Immigration and ICE can't tell a U.S. citizen from an illegal immigrant.

Facts,

You presented what I would term small facts that don't tell the real picture of what has taken place over the past seven years most especially under Obama. The numbers change has been dramatic indeed.

The Pew Research Hispanic Center publishes the best numbers available and they are radically different than in the early 2000s. As I said earlier, the net flow of illegals is down to net zero. The immigrant population has actually fallen. Border apprehensions are way down, but that is because border crossings have plummeted. The Obama administration policy of going after illegal immigrants at their work places has not only netted big numbers, but has convinced the illegal community that they are not safe even after clearing the border and securing a job. That has been psychologically big. I am not a big Obama fan, but I am willing to give credit where credit is due. I consider immigration to be one of his few successes.

I think that you will be surprised if you take a look at the immigration numbers and the radically reduced illegal border crossings.

Now, the next step, and one that will actually help the US economy, is to pass the bill that will create a path to legal residence for those that qualify. Both Democrats and Republicans seem to understand that this needs to happen. What other realistic option do we have?

chet123 Get your facts straight. The bill Reagan signed which the dems in both houses of congress wrote had strong border security (like this one) that was promised but never materialized. That bill was supposed to cure illegal immigration. instead we wound up with millions more. If we would just enforce the laws we already have we could stop 100 percent of illegal immigration. And by the way Robin Smith is not in congress HA HA HA

Go ahead and pass the immigration bill that is porked up to appease and please some members of congress but cannot and will not be enforced. So, nothing changes and congress and Obama can put a notch on their belt for passing it. More people can then legally avail themselves of free stuff provided by those able to maintain a decent job and the dwindling number considered wealthy. Moan and groan all you want to that is just the way it is going to be.

Some can tell you in 100 words or less what the bill does and how great it is. But, it is now several thousand pages and growing and few can read it and know what it says. Most in congress admit they haven't read it but will vote for it in principle....think about that for a minute.

Robin has a barely suppressed bigotry in the face of CBO analysis stating “the CBO finds immigration reform will save $197 billion over 10 years.” The goal is maintain WASP dominance. I cannot think of one place where a wall or fence has been erected that peace and harmony followed. Just opposite is virtually a guarantee.

I wonder if my experience is metaphorical. In our first home we had neighbors somewhat senior and different inclinations than my wife and I. They had a Jacuzzi and were constantly baiting us to join in their “merry making.” I built a privacy fence and the neighbors were offended regardless of our point of view that it was for their privacy as well as ours. It was the beginning of bad relations that could never be healed.

We eventually sold out and moved away.

Chet123 I did not mean to offend you. I was just trying to set the record straight about immigration. This is the same type of bill that the government is considering now. The fact is unions played a very important role in shaping the work place. but federal law has rendered them useless. In America today if your employer is not treating the worker fair they have legal options. Another option is to find another job.So bad mouthing the same people who create the jobs is not the answer.If it were up to the progressives nobody would have a job everybody would work for the big bloated corrupt government. As a conservative I believe in equal and fair treatment for everybody. What an individual does with the freedom of choice is up to them. Also I never mix religion with politics because what I believe is none of anybody's business. Again there was no malice intended in my first letter and if i offended you I am sorry. A serious debate should never end with someone getting upset In the end we are all Americans and should be proud.

The problem were having in Washington is both partys are corrupt.We have no leadership at the top and haven't had in so long nobody remembers what true leadership is. The left complains about the right and the right complains about the left. The truth is they are the same and that's sad .The sadder part is what we are doing to the country that the greatest generation left for us. It used to be what can you do for your, now its what can I get for free.I think we owe it to the next generation to leave them something other than 17 trillion dollars of debt and nothing to show for it .
