Jury in Colorado theater shooting trial won't be sequestered

DENVER - The judge overseeing the case against Colorado theater shooting suspect James Holmes says the jury won't be sequestered.

Jurors also will be able use phones and computers outside of court during the trial, but not during deliberations.

The judge issued both guidelines Thursday.

Holmes is accused of killing 12 people and injuring 70 others in July. He pleaded not guilty by reason of insanity to murder and attempted murder charges.

Prosecutors are seeking the death penalty.

Defense lawyers wanted the jury sequestered during the trial, which is scheduled to start in February and to last four months. They also wanted the jurors barred from having phones, laptop computers or other electronics devices.

The judge said neither measure was practical. He said he could take other steps to shield jurors from outside influence.
