DUI charges against businessman expunged

Charges of driving under the influence filed against local businessman Albert Waterhouse have been nullified and expunged from his record after prosecutors could not provide proof that he was intoxicated when he was arrested in January.

The months-long case wrapped up in mid-August, when a special judge and prosecutor -- appointed after local officials recused themselves from the case -- nullified the charges because of an overall lack of evidence.

Waterhouse was arrested Jan. 16 after an anonymous caller told police his car was being driven erratically. Waterhouse's attorney, Jerry Summers, argued the call could have come from a disgruntled former business associate who was trying to capitalize on Waterhouse's past DUI arrests.

He previously pleaded guilty to DUI in February 2013.
