Woman sues Soddy-Daisy cemetery after falling into open grave

A Knoxville woman is suing a Soddy-Daisy cemetery for $75,000, claiming she suffered multiple injuries after falling into an open grave during a funeral last year.

In a complaint filed Sept. 23, Marcia Brackfield said she was attending a funeral at Millsaps Cemetery in Soddy-Daisy last September when she stepped on what she thought was grass — but was actually green plastic covering an open grave.

“The plaintiff plummeted into the grave and suffered multiple severe and permanent injuries,” the complaint states.

Because of the fall, Brackfield said she has been forced to seek medical treatment, suffered mental and emotional anguish and lost ability to earn wages.

She alleges Millsaps Cemetery and Lane Funeral Home are responsible for her injuries because they failed to “inspect and discover the dangerous condition in the customer path.”

This kind of garbage is one of the reasons for tort reform. Frivolous lawsuits. If you can't distinguish between natural green grass, and green plastic, maybe you shouldn't leave the house without your seeing eye dog.

The open lot was covered with grass. Anyone could have fallen in. It's not about being careless.

Why have this type of a hazard to trap and injure the unsuspecting? We are at the cemetery preparing to bury a body in the ground.

I’ve always wondered who came up with the stupid idea of covering the grave to conceal its existence. I for one hope this lady recovers her expenses and gets a little more blood from these outfits for her suffering.

She's full of $^#$! You moron walked right into an open grave. Oh my bad it was covered with Artificial green grass tarp. Duh! If i crash into a parked vehicle thats the same color as the building its parked in front of can i sue for failure to yield right of way? "suffered mental and emotional anguish and lost ability to earn wages". Sorry dead beat. the whole world would be better off if you stayed in the hole. Using a crooked system to line your pockets.
